Formidable Forms is a product owned and operated by Strategy11 LLC. By becoming an affiliate for Formidable Forms, you are entering into a binding agreement with Formidable Forms.

As an authorized affiliate (Affiliate) of Strategy11 LLC (Formidable Forms), you agree to abide by the terms and conditions contained in this Agreement (Agreement). Please read the entire Agreement carefully before registering and promoting Formidable Forms as an Affiliate.

Your participation in the Program is solely to legally advertise our website to receive a commission on memberships and products purchased by individuals referred to Formidable Forms by your own website or personal referrals.

By signing up for the Formidable Forms Affiliate Program (Program), you indicate your acceptance of this Agreement and its terms and conditions.

1. Approval or Rejection of the Application

We reserve the right to approve or reject ANY Affiliate Program Application in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.

2. Commissions

Commissions are paid on initial purchases only, no commissions are earned on subsequent purchases by the referred user or on yearly renewals.

Commissions are paid once per month with a minimum payout of $100. To qualify, the referred account must remain active for at least 37 days after purchase.

You cannot refer yourself, and you will not receive a commission on your own accounts. There is also a limit of one commission per referral. If someone clicks the link on your site and orders multiple accounts, then you will receive a commission on the first order only.

Payments will only be sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.

3. Termination

Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

Inappropriate advertisements (false claims, misleading hyperlinks, etc.).

Spamming (mass email, mass newsgroup posting, etc.).

Advertising on sites containing or promoting illegal activities.

Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under existing Federal Trade Commission guidelines and regulations, or any applicable state laws.

Any violation of intellectual property rights is prohibited. Formidable Forms reserves the right to require a trademark or license agreement from any affiliate or party using Formidable Forms trademarks in order to protect our intellectual property.

Offering rebates, coupons, or any other form of promised kickbacks from your affiliate commission as an incentive is not permitted. However, adding bonuses or bundling other products with Formidable Forms is allowed.

Self-referrals, fraudulent transactions, or any suspected affiliate fraud are strictly prohibited.

In addition to the foregoing, Formidable Forms reserves the right to terminate any affiliate account at any time for violations of this Agreement or at its sole discretion.

4. Affiliate Links

You may use both graphic and text links on your website and in email communications. You may also promote Formidable Forms through online or offline classified ads, magazines, and newspapers.

You may use the graphics and text provided by us, or create your own promotional materials, provided they are appropriate and comply with these terms, including the restrictions outlined in Condition 3.

5. Coupon and Deal Sites

Formidable Forms occasionally offers coupons to select affiliates and newsletter subscribers. Unless you have been explicitly pre-approved and assigned a branded coupon, you may not promote or reference any Formidable Forms coupon or discount.

The following terms apply to any affiliate promoting Formidable Forms in connection with deals, discounts, or coupons:

• Affiliates may not use misleading text, links, buttons, or images that imply the availability of coupons, discounts, or deals beyond those explicitly authorized for that affiliate.

• Affiliates may not bid on keywords or phrases such as Formidable Forms coupons, Formidable Forms discounts, or any other terms suggesting that coupons are available.

• Affiliates may not use pop-ups, pop-unders, iframes, frames, or any other visible or hidden methods to set affiliate cookies unless the user has shown a clear and explicit intent to activate a specific, authorized deal by clicking a clearly labeled link, button, or image. All affiliate links must direct users to the Formidable Forms website.

• Coupon, deal, or savings information must be clearly visible to the user before an affiliate cookie is set. Phrases such as “click here to see coupons” that open the merchant site or set a cookie without displaying actual coupon details are not permitted.

• Affiliate sites may not display “Click for Deal,” “Click to See Coupons,” or similar language when no valid coupon or deal is available. Any affiliate found using such language to redirect users or set cookies without an active, authorized offer will be immediately removed from the program.

6. Pay Per Click (PPC) Policy

PPC bidding is NOT allowed without prior written permission.

7. Liability

Formidable Forms will not be liable for any indirect, incidental, or consequential damages, including but not limited to lost revenue or lost commissions, resulting from affiliate tracking failures, loss of database files, or any acts intended to harm the Program or our website(s).

Formidable Forms makes no express or implied warranties regarding the Program, memberships, or products sold. We do not guarantee that the Program or our website(s) will be error-free, and we will not be liable for any interruptions, errors, or other operational issues.

8. Term of the Agreement

This Agreement begins when you are accepted into the Program and continues until your Affiliate account is terminated.

Formidable Forms may modify the terms and conditions of this Agreement at any time. If you do not agree with any modifications, your sole option is to terminate your Affiliate account. Continuing participation in the Program constitutes your acceptance of all changes.

9. Indemnification

Affiliate shall indemnify and hold harmless Formidable Forms and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by Formidable Forms to transmit and distribute materials, from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of Affiliate.

10. Governing Law, Jurisdiction, and Attorney Fees

This Agreement shall be governed by and construed in accordance with the laws of the United States and the State of Utah. Any dispute arising under or related in any way to this Agreement shall be adjudicated exclusively in the state courts located in Salt Lake County, Utah.

In the event of litigation to enforce any provision of this Agreement, the prevailing party will be entitled to recover from the other party its costs and fees, including reasonable legal fees.

11. Electronic Signatures Effective

The Agreement is an electronic contract that sets out the legally binding terms of your participation in the Formidable Forms affiliate program. You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the Formidable Forms application process. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.
